General conditions of sale

The conditions hereunder are for the exclusive regulation of sales by Vision Objects to consumers of Software Products offered in the e-commerce "Web Store" section of our web site.

For Software Products license terms, please read the end-user license agreement included in the Software Products.

Article 1 – Price

Prices of our products are indicated in euros, and are tax-inclusive.
All orders are payable in dollars.
Vision Objects reserves the right to change prices at any time without prior notice.

Article 2 – Orders

Orders must be passed via the web site www.visionobjects.com under the "Web Store" section.

Any orders signed by a customers through means of a double-click with a mouse constitutes an irrevocable acceptance that can only by brought into question within the limits of the general conditions of sale here present or customer withdrawal rights or if the product is out of stock.

This double-click associated with the authentication and non-repudiation procedure and with the protection of message integrity constitutes an electronic signature. This electronic signature has an equivalent value between the contractual parties to a handwritten signature.

The order’s confirmation date is the date on which online credit card payment was carried out.

Article 3 – Order confirmation

When you click the "Submit" button following the order procedure, you declare your full and unreserved acceptance of the General Conditions of Sale in their entirety. The data saved by Vision Objects constitutes proof of all the transactions carried out between Vision Objects and its customers and only these data will be valid in case of any dispute between Vision Objects and the customer.

Article 4 – Order cancellation

Vision Objects reserves the right to cancel any order from a customer with whom there is an existing dispute in relation to payment of a previous order.

Generally speaking, you may cancel or alter your order online at any time, providing that payment has not yet been made.

Article 5 - Payment

You may pay for orders with one of the following payment cards: Visa, Mastercard, American Express, French Carte bleue. The card will be debited only once the product has actually been downloaded by the purchaser.

Article 6 - Security

The online sales site is protected by a security system. We have adopted an SSL encryption procedure to provide the best possible protection for the sensitive data pertaining to online payments.

To protect customers against any intrusion, Vision Objects does not stock credit card numbers on its IT servers: card numbers are processed by Plimus.com which sends Vision Objects an authorization number.

Article 7 - Delivery

Products sold on the Vision Objects site are downloadable applications. The downloaded application is a trial version. Delivery consists of the purchase of a license key (a sequence of characters) which will allow the application to be used in a permanent manner. Consequently, delivery is considered to have taken place once the customer has received his/her license by e-mail.

The delivery procedure for a license key purchased via the "Web Store" occurs in the following way

Customer will be re-directed to our Ecommerce partner www.plimus.com that will handle the secure payment
Complete customer information page providing valid Email address to receive your licence key details
Click “NEXT”
Complete Credit Card Information
Click "SUBMIT"
An e-mail message will be sent to the customer (in accordance with the personal information given) containing the receipt (that should be printed out) and the license key (sequence of characters)

Article 8 – Returns policy

This right of return cannot be invoked due to the nature of the products sold.

Article 11 – Intellectual Property

Using Software and the accompanying documentation is governed by personal and specific rights of use, concerning copying, conditions of use and so on. You must respect the general conditions of sale of these products.

All intellectual property rights linked to products, including trademarks, patents, copyright and proprietary knowledge, linked to product design, development and marketing are and remain the exclusive and absolute property of Vision Objects. These present conditions in no way or form permit the transfer of all or part of these rights to the Customer or any user of the product or generally to any third party.

Article 12 - Responsibilities

The products put on sale conform to current French law and applicable standards. Photographs, texts, drawings, information and reproduced characteristics illustrating the products are merely for illustration purposes and are in no way binding. Vision Objects cannot be held responsible for product unavailability, force majeure, disturbance or industrial action particularly in communications services, floods, fire or any apparent errors. Vision Objects shall not be liable or responsible for any incidental or indirect damage such as loss of business, loss of profit, loss of opportunity, damages or costs that may occur from having purchased the products. We recommend that customers safeguard the data contained in the software purchased. Vision Objects cannot be responsible for any loss of data or files or other damages defined in the previous article. Total or partial inability to use the products, especially in the case of hardware or material incompatibility shall not be compensated or reimbursed by Vision Objects, nor shall their responsibility be invoked. Hyperlinks may lead to the Vision Objects Internet sites or pertain to third-party sites. Vision Objects makes no warranty for third-party sites and accepts no responsibility for any inappropriate or illegal content that these may contain, in accordance with current laws and jurisdiction.

Article 13 - Warranty

Products purchased from Vision Objects gives you the right to the warranty indicated in the license terms. This does not affect your statutory rights. For information concerning after-sales service in case of product failure or problem, please contact our Support service at +33 (0)2 28 01 49 50 or by e-mail at technical.support@visionobjects.com. To benefit from product warranty, customer must be able to produce the original purchase receipt.

Article 14 – Applicable Laws

The present contract is subject to French law. In case of litigation, the competent authority shall be the tribunal of Nantes (France), unless otherwise permitted by law.

Article 15 - Confidentiality

Vision Objects will not divulge any personal information supplied by customers. This remains strictly confidential.

In accordance with the law of France concerning electronic documents and civil liberties (law of 6 January 1978), you have the right to access, rectify and request the removal of your personal information stored by Vision Objects.
To do this, simply make your request by e-mail (privacy@visionobjetcs.com) or by letter (Vision Objects SA - Service Client -2 allée des Vieux Tilleuls – 44301 Nantes) indicating your first names, surname, address and if possible your customer reference.
